Financial Disputes (ACF), operational starting from 9 January 2017.<\/p><p>The ACF decides on disputes which concern the violation by intermediaries of the obligations of diligence, correctness, information and transparency that the legislation places on them when they provide investment services.<\/p><p>Disputes between a retail investor and an intermediary may be submitted to the ACF, as identified by the ACF Regulation [article 2, paragraph 1, letters g) and h)].<\/p><p>The ACF therefore intends to provide subscribers who have unsuccessfully lodged complaints with the financial intermediaries of which they are clients with an alternative, agile and rapid means of resolving disputes.<\/p><p>Lemanik SIM S.p.A. joins the ACF. financial services, products and markets and prevention of money laundering and terrorist financing; product safety and compliance; environmental Protection;<\/li>\n<li>other acts or omissions that harm the financial interests of the European Union and\/or concern the internal market.<\/li>\n<\/ul>\n<\/div>\n<div>\n<div>Illegal conduct (or suspected conduct) is also subject to reporting as it does not comply with the Code of Ethics, Policies and Procedures adopted by the Company.<\/div>\n<div>&nbsp;<\/div>\n<div>&nbsp;<\/div>\n<div><b>How to make a report<\/b><\/div>\n<div><b>&nbsp;<\/b><\/div>\n<div>In compliance with the provisions of Legislative Decree 24\/2023, Reports can be made according to the channels indicated below, which guarantee the confidentiality of the identity of the Whistleblower in the management activities of the report.<\/div>\n<div>&nbsp;<\/div>\n<div>\n<ul>\n<li>Internal reporting channel<\/li>\n<\/ul>\n<div>\n<div>WRITTEN FORM<\/div>\n<div>&nbsp;<\/div>\n<div>The Company is equipped with a platform suitable for guaranteeing, also through encryption tools, the confidentiality of the identity of the Whistleblower, of any third parties mentioned in the Report, as well as of the content of the report and the related documentation. Access to the platform is not permitted to unauthorized personnel.<\/div><div><br><\/div>\n<div>The platform can be reached at the following address: wb.lemanikgroup.com<\/div><div><br><\/div>\n<div>ORAL FORM<\/div><div><br><\/div>\n<div>Through a voice messaging system, available on the platform or by requesting a direct meeting, at the request of the Whistleblower, available on the platform.<\/div>\n<div>&nbsp;<\/div>\n<div>The Company is the data controller pursuant to Regulation (EU) 2016\/679, (so-called GDPR) and communicates a specific privacy information in this regard. The personal data of the Whistleblower, the Reported Persons and all subjects involved in the Report are processed for the exclusive purpose of fulfilling the legal obligations set out in paragraph 2 and in any case respecting the provisions of the Regulation (EU 2016\/679) and the Legislative Decree. 51\/2018. The identity of the Whistleblower cannot be revealed to people other than those competent and authorized to receive or follow up on the Reports (responsible for managing the report) without his express consent.<\/div>\n<\/div>\n<div>&nbsp;<\/div>\n<div>\n<ul>\n<li>External reporting channel<\/li>\n<\/ul>\n<div>\n<div>In the cases provided for by law, the Whistleblower may also make a so-called \u201cexternal report\u201d.<\/div>\n<div>&nbsp;<\/div>\n<div>In this case, the recipients of the Report may be, for the matters within their competence, the National Anti-Corruption Authority (ANAC) or, as provided for in Article 4-duodecies of the TUF, the Supervisory Authorities, Bank of Italy and Consob.<\/div>\n<div>&nbsp;<\/div>\n<div>In particular, the Bank of Italy and Consob receive, each for the matters within their competence, reports that refer to violations of the provisions of the TUF and the related implementing provisions as well as of European Union acts directly applicable in the same matters.<\/div>\n<div>&nbsp;<\/div>\n<div>The legislation provides for the possibility of external reporting to the ANAC if:<\/div>\n<div>&nbsp;<\/div>\n<div>\n<ul>\n<li>an internal report has already been made and it has not been followed up;<\/li>\n<li>there are reasonable grounds to believe that, if an internal report were made, it would not be followed up effectively, or that the report itself could be a reason for retaliation\/discrimination;<\/li>\n<li>there is reasonable reason to believe that the violation may constitute an imminent or obvious danger to the public interest.<\/li>\n<\/ul>\n<\/div>\n<div>The guidelines relating to the procedures for the presentation and management of external reports to the ANAC are available on the Authority&#8217;s website.<\/div>\n<div>&nbsp;<\/div>\n<div>On the Bank of Italy website, however, the &#8220;Whistleblowing Report&#8221; form is available and can be sent to the Bank of Italy:<\/div>\n<div>&nbsp;<\/div>\n<div>\n<ul>\n<li>via email to whistleblowing-vigilanza@bancaditalia.it;<\/li>\n<li>by ordinary mail, to the address Banca d&#8217;Italia, via Nazionale, n. 91 &#8211; 00184 Rome, to the attention of the Banking and Financial Supervision Department &#8211; CRE Service &#8211; SRE Division (the envelope must bear the wording &#8220;confidential&#8221;).<\/li>\n<\/ul>\n<\/div>\n<div>The Bank of Italy has also added the possibility of submitting a complaint directly via the &#8220;online services&#8221; platform.<\/div>\n<div>&nbsp;<\/div>\n<div>Consob, however, has activated two dedicated channels, one telephone and one electronic, for receiving reports; therefore, reports can be communicated:<\/div>\n<div>&nbsp;<\/div>\n<div>\n<ul>\n<li>by telephone on 06 8411099;<\/li>\n<li>by email, using the forms available on the Authority&#8217;s portal, to the whistleblowing@consob.it email address.<\/li>\n<\/ul>\n<\/div>\n<div>Furthermore, Consob also provides the possibility of sending reports via ordinary mail, to the address: Consob, Via G.
